TERMS OF SERVICE
TORSON SALES TERMS AND CONDITIONS (SOUTH AFRICA)
Effective Date: 30 June 2025
These Sales Terms and Conditions ("Terms") govern all orders placed with MegaRoot Creations (Pty) Ltd t/a TORSON ("TORSON", "we", "us" or "our") by any customer ("you" or "Customer") for the purchase of our products within the Republic of South Africa. By placing an order via WhatsApp or our website, you agree to be bound by these Terms.
1. DEFINITIONS
1.1 “Business Day” means any day other than a Saturday, Sunday or official public holiday in the Republic of South Africa.
1.2 “Delivery Partner” means PAXI, Pepkor Group’s parcel delivery service utilised by TORSON for nationwide deliveries.
1.3 “Meet‑Up Pickup” means physical collection of the order by the Customer at an agreed public location arranged between TORSON and the Customer.
1.4 “Order Confirmation” means the written acceptance issued by TORSON confirming receipt of payment in full and acceptance of the order.
2. SCOPE OF APPLICATION
2.1 These Terms apply to all sales of TORSON products made to Customers located within South Africa, regardless of the ordering channel.
2.2 Any contradictory or additional terms proposed by the Customer are expressly rejected unless agreed to in writing and signed by an authorised representative of TORSON.
3. ORDERING PROCESS
3.1 Channels: Orders may be placed either:
a. Via WhatsApp at +27 [0769340620]; or
b. Through our website (https://www.megaroots.simdif.com).
3.2 Information Required: You must provide accurate recipient details, delivery address, contact number and email address.
3.3 Order Review: Once we receive your request, we will confirm product availability and total cost (including delivery fee where applicable) via WhatsApp or email.
3.4 Order Acceptance: An order is deemed accepted only when TORSON issues an Order Confirmation after receipt of full payment.
4. PRICING AND CURRENCY
4.1 All prices are quoted in South African Rand (ZAR) and include VAT where applicable.
4.2 Prices are subject to change without notice but changes will not affect already confirmed orders.
5. PAYMENT TERMS
5.1 Accepted Methods:
a. Secure Online Payments – card payments processed via secured built-in online payment links on the website.
b. Cash – accepted only at Meet‑Up Pickup before the goods are handed over.
5.2 No Payment on Delivery: We do not accept cash‑on‑delivery (COD) or payment after dispatch. Goods will not be shipped or released without confirmed payment.
5.3 Security: Online transactions are encrypted to PCI‑DSS standards. TORSON does not store card details.
5.4 Proof of Payment: EFT deposits are not accepted. All payments must clear instantly (card or cash).
6. DELIVERY AND PICKUP
6.1 Nationwide Delivery via Paxi and The Courier Guy
a. Coverage: Delivery to your door or any Pep store nationwide.
b. Fees & Timing: Standard delivery fee communicated at checkout; typical transit 3–7 Business Days from Order Confirmation.
c. Tracking: A unique tracking number will be sent to you. You can track at our website for free.
d. Collection Window: Pep will notify you via SMS when your parcel is ready; collect within 14 calendar days with your ID and PIN.
e. Risk of Loss: Risk transfers to you upon TORSON’s hand‑over of the parcel to PAXI. Insurance is available on request at extra cost.
6.2 Meet‑Up Pickup
a. Locations: Cape Town CBD and mutually agreed public venues.
b. Scheduling: Pickup date and time confirmed via WhatsApp. Late arrivals beyond 15 minutes may require rescheduling.
c. ID Verification: Present a valid South African ID or driver’s licence plus Order Confirmation.
d. Risk of Loss: Risk transfers upon physical hand‑over of the goods to you.
6.3 Delivery Delays
TORSON is not liable for delays caused by the Delivery Partner, force majeure events, or incorrect customer information. We will, however, assist in tracing delayed parcels.
7. RETURNS AND EXCHANGES
7.1 Return Window: You may return unworn and unused items within 5 (five) Business Days of the delivery date (PAXI collection date) or Meet‑Up Pickup date.
7.2 Return Eligibility Conditions:
Product must be in original condition, unwashed, unworn, with tags attached and in the original packaging.
A valid proof of purchase (Order Confirmation and PAXI collection slip or pickup receipt) is required.
7.3 Return Procedure:
a. Contact TORSON via WhatsApp within the return window, stating the reason for return.
b. TORSON will issue a Return Authorisation (RA) number and return instructions.
c. Ship the item back via PAXI or return at the next available Meet‑Up.
7.4 Return Shipping Costs:
Defective Items or Wrong Fulfilment: TORSON bears the return shipping cost and will reimburse reasonable PAXI return fees.
Size or Preference Returns: Customer bears the shipping cost.
7.5 Inspection & Refund: Upon receipt, TORSON will inspect the item within 2 Business Days. If approved, we will:
Refund via the original payment method within 5 Business Days; or
Exchange for a different size or product (subject to stock) and dispatch within standard delivery times.
7.6 Non‑Returnable Items: Items showing signs of wear, damage, or missing labels/packaging will not be accepted and will be returned to you at your cost.
8. WARRANTY AND LIABILITY
8.1 TORSON products carry a 6‑month statutory warranty against manufacturing defects under the Consumer Protection Act, 68 of 2008.
8.2 The warranty does not cover damage due to misuse, normal wear and tear, improper care, or unauthorised modifications.
8.3 To the fullest extent permitted by law, TORSON’s liability for any claim arising out of or in connection with these Terms shall be limited to the purchase price paid for the product giving rise to the claim.
9. PRIVACY AND DATA PROTECTION
Personal data collected during ordering and payment is processed in accordance with our Privacy Policy (available on our website) and the Protection of Personal Information Act, 4 of 2013 (POPIA).
10. FORCE MAJEURE
TORSON will not be liable for any failure to perform or delay in performance caused by events beyond its reasonable control, including but not limited to strikes, acts of God, epidemics, riots, or governmental actions.
11. GOVERNING LAW AND DISPUTE RESOLUTION
11.1 These Terms are governed by the laws of the Republic of South Africa.
11.2 Any dispute shall first be referred to internal escalation. If unresolved within 10 Business Days, either party may refer the matter to the Consumer Goods and Services Ombud (CGSO) or the Small Claims Court, where applicable.
12. SEVERABILITY
If any provision of these Terms is held invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
13. CHANGES TO TERMS
TORSON reserves the right to amend these Terms at any time. Updated Terms will be posted on our website and will apply to orders placed after the effective date of the update.

4. DISCLOSURE TO THIRD PARTIES
We do not sell, rent, or trade your personal information. However, we may share it with:
PAXI, to facilitate parcel delivery and tracking Yoco, to process secure payment transactions IT service providers, for data hosting, email management, or technical support Legal authorities, when required to comply with legal obligations
All third-party service providers are required to maintain the confidentiality and security of your information and to use it only for the purposes we specify.
5. DATA SECURITY
We take appropriate technical and organisational measures to safeguard your personal information from loss, misuse, unauthorised access, disclosure, alteration, or destruction. These measures include:
Encrypted payment processing via Yoco Password-protected systems Secure WhatsApp Business account with end-to-end encryption Limited access to customer data on a need-to-know basis
6. DATA RETENTION
We will retain your personal data only as long as necessary for the purposes outlined in this policy or to comply with legal obligations. Typically:
Order-related data: retained for 12 months after completion Financial transaction records: retained for 5 years (as per SARS requirements) Marketing opt-ins: until you unsubscribe or withdraw consent
